Hi Sajhaitis, need your genuine suggestion on the issue.

I am employed (FTE) at a great company right now, but the thing is my TPS EAD is expiring soon. I did let HR know about the federal register notice and auto extension of current TPS EAD for I-9 verification. Since this auto extended TPS EAD I-9 verification is not a regular occurrence at HR I am wondering what might entail? Because it will take a while to receive the hard copy of renewed EAD.

Will I be denied employment even when I submit federal register notice with current EAD?

My TPS/EAD application has been recieved by USCIS and I am expecting I 797 notice. Will this notice say anything about auto extension of current EAD? Will this notice prove as proof of employment eligibility?

I am really worried about employment.

Let me know what you think, what other sajhaitis have done in situation like this?

Keep quiet , they won’t even notice that your EAD is expiring. They have better things to do. When u get new EAD then u can give them a copy. Ask them to file h1/ gc after that.

The Federal Register notice states that the EAD has been extended until Dec 24, 2018 and the employer should accept it. You should be fine, just explain them. Good Luck

You should have never relied on a temporary status to get a permanent position. It's better to seek for employment based sponsorship either with the same company or someone who is willing to. Having said that I believe the federal registry notice should suffice and or the receipt would definitely work (past experience).

@ajoshinp -- They know, infact they already know that it's expiring. i-9 verify triggers 60 day notice/alert for re-verification. If it is auto extended prior to 60 day they would know about it too. but this auto extension happened after 60 day I guess there is no notification about that. Hence they reached out to me for an updated EAD.

@srana -- Yes I should not have relied on TPS for full time but what am I supposed to do as a contractor? pack my life in suitcase and move state to state? That would be a miserable life. By saying that it doesn't mean I am not looking for AoS with other means.

My personal experience hai....
It is not true that they will "not even notice your EAD is expiring". I got few emails about my EAD expiring, from my employer's automated system, like 2 months ago. I already sent them a copy of the Federal Register notice. So, we're good there.

They cannot legally terminate you just because your TPS EAD is expiring this month. The federal notice does state that you get an automatic extension until December 24, 2018.

file gc . Temporary work won’t help u in long term

Employers are not required by law to verify the information on i-9, unless they want to by participating in E-verify. Only a few employers participate in E-verify. The information on your i-9 is only for employer records. They do know that it is expiring.
Going back to F1 status is always an option.
